paternal rights

If I am married, but separated from my wife what rights do I have to my daughter? She is trying to send her to another state without my consent.

You have as much of a right to have your daughter in your care as your spouse. However, without a court order, there is no schedule that can be enforced.

I would strenuously suggest that you file for legal separation or divorce and seek a temporary order which establishies a parent schedule and precludes the parent from moving the child out of state.
