Legal Question in Family Law in Minnesota

I have been seperated from my hisband for about 20 years with the exception of 5 months in 1995, He is living with another woman and has been for the past 12 years. I understand that MN. is waht they call Common-Law state. So what must I do to get divorced fromm y husband? Thjere are no children nor assets just a simple divorce agreed by both sides.

You must file for divorce and have a court enter a divorce decree with provisions indicating the division of assets, debts, waivers of spousal support etc.. If you have an agreement with your spouse, both parties may include their stipulations in a Marital Termination Agreement that is filed with the court.

Given the length of the marriage, you would be wise to have an attorney draft your documents. Though the process can be simple, there are many potential pitfalls.
