My son is not married but has been living with the mother of his child. They are now separating. What are his legal rights regarding the child? He is named on the birth certificate.

The unfortunate answer is that, by default, unless there is a court order to the contrary, the mother is considered the custodial parent. The father, your son, has no enforceable rights unless the parties reach an agreement that is memorialized as a court order or he commences a custody/parenting time action.
