Legal Question in Family Law in Minnesota

Terminating Parental Rights

I need help to terminate my ex-wifes parental rights. She has physically & mentally abused our daughter. I had a 6mo. NCO ordered by a judge. And, now that has expired. I have the county and everyone else on my side. But, they all say that I need to start the proceedings. I need help here. My daughter has told her school councelor that she is afraid to be near her mom. Please help me someone.

Re: Terminating Parental Rights

Termination of parental rights is a serious issue and one that a court does not take lightly. It is far more likely that a court would impose some interim restriction such as supervised parenting and completion of parenting classes depending on the particular issue. Regardless, the matter is likely to require an evidentiary hearing.

Re: Terminating Parental Rights

Thank you for your question.

Many more facts are necessary to properly evaluate your case, but at the outset I should caution you that it is rather difficult to simply terminate another parent's rights, even if you have a no contact order. Further, if you have custody of your daughter, I think it unlikely the juvenile court would proceed, since your child's safety is protected by virtue of you having custody.

If you have further questions or concerns, and can supply additional information, please feel free to contact me. My contact information is below.
