Small Office of Corporation

How does it work if the Main Business is in Las Vegas with the majority of Employees but then there is a division of the company with less than 50 employees in Burnsville, Minnesota? Total Employees for the whole business is 294. There is one other small office in San Diego.

For FMLA purposes, it counts employees based upon the number within 75 miles of the worksite at which the employee requesting leave provides services. In this case, under the federal law, you could not count the employees in Las Vegas or San Diego. State law may provide a different answer. Therefore, you should consult with an attorney in your state to determine what rights you may have.
