Damage to car after installation

I was having my windshield replaced by an auto glass company. I left both of my front doors wide open when I left the tech to install the glass. Before this there was no damage to my front passenger quarter panel. There is a little rust where the door and quarter panel meet, but the door and quarter panel had never clicked together or rubbed at all. The tech came to ask me if I had ever had problems opening my door. I had told him no. I went out to the car to see that now the door is pushing the quarter panel in causing some serious damage. He says that he did not push on it, and his boss came to look at it and said that he said he felt that since the rust was there his ''employee was in the wrong place at the wrong time.'' I would like to take this to small claims court since they told me they will do nothing. They never filled out a pre install damage report for me to sign and there was no quarter panel damage before he started to install the glass. Please help me.

Sounds like a claim to me. I have a notion, however, that you would be best off handling it on your own without an attorney. The attorney fees would eat up any benefit you might receive. You can get the forms and instructions at your local county court house. Last I checked, the filing fee was $25.

I bet you would not have felt like suing if they would have offered the glass job for free or some such kind of a deal.

I think some kindness would go a long way to keep some of these things out of court.

But if they are going to be bastards, sue them.
