Legal Question in Immigration Law in Minnesota

Our client filed the I130 and her husband's visa was approved. This was nearly three years ago. The husband is stuck in africa. We continue to make phone calls and emails to see what the hold up is and the only answer we get is administrative processing. I think the hold up is that our client just didn't send in the next form and immigration is waiting on that. Am I right?

Administrative processing can last for weeks or even years. If case is in administrative processing, it might be because there are some security clearances still pending on a foreign husband.

I-130 is not a visa. I-130 is an initial petition only. Approval of the I-130 doesn't always mean that a visa will be approved. If the case is in admin processing it means that NO visa was approved yet.

You may also notify the AILA Ombudsman, President of the U.S. or have your Congressman do a congressional hearing. They have gotten the ball rolling in some of my cases.
