Jail

An alien was put on hold before serving time for a state offense. He has since served his time but is still in jail awaiting immigration. How long does immigration have to pick him up and charge him?

There is no time line and he/she can be held indefinitely.

When a person is detained under an immigration hold, it does not necessarily mean that the Immigration Service will transfer the person to a different location. It usually just means that jurisdiction over the person's custody is now with the Immigration Service.

The Immigration Service typically reviews a person's custody situation every 90 days. If the person has some form of relief from removal/deportation, he can seek to be released on bond.

These types of cases usually are very complicated and anybody trying to fight deportation should retain an attorney for assistance.
