Legal Question in Immigration Law in Minnesota
Marriage question
My girlfriend and I have been dating for over 2 years now. She is asian and here on a student visa. She graduated this summer. She recently found out that due to the school not updating some of her paperwork her permit to work was declined and she has to leave in a few months. She could re-apply for the permit but it won't be done in time.
We had been planning on getting married next summer. Currently we would not be able to live together if we were to get married now. She is currently living with an aunt and uncle who are citizens. I can easily support her with my income.
Would us getting married and not living together for a year until we could be together violate immigration laws? We are very serious about each other and wouldn't be doing this to ''get around immigration laws''. We just can't live together for almost a year.
Also, would her aunt and uncle be able to sponsor her? I tried looking at which relatives can sponsor someone and the regulations aren't very clear.

I've handled cases like yours before. As long as it is a valid marriage, then living apart is O.K. You will need to extensively document your case in preparation for your interview.

So long as you are a citizen there should not be any problems. However, showing that your marriage was entered into in good faith and that there is evidence to show that you two continue to be married in good faith will be a requisite.
