Legal Question in Immigration Law in Minnesota
undocumented husband
My husband and I have been living in Mexico for the past year. We met and married in the states, but since our luck in Mexico has not been great, we want to go back. If I file the family petition I 130 on my husband's behalf, and during the two year waiting period, he returns to the states illegally, what are the legal consequences to his case?

If your husband is in the U.S. illegally and the Immigration Service arrests and deports him, the law generally bars him from returning to the U.S. for 10+ years.
It is advisable that he remain in Mexico until he can get a visa from the U.S. consulate.
