Legal Question in Employment Law in Minnesota
I got this email from my boss
Any team member that fails to accurately clock a lunch period (5 hours or more worked) will be an automatic Letter of Understanding. This is a major policy break as well as breaking state and federal laws. This will not be tolerated going forward.
As a reminder, you MUST take your break within the first 4 hours of your shift if you work 5 or more hours in your shift. That gives you plenty of time to take a lunch break. Planning on taking your break on the 4th hour is not a good idea as you could get busy. That excuse won't be accepted anymore.
Consistent offenders will be sent to Loss Prevention for Time Card Fraud Investigations/ Time Theft from the company, which is automatic termination of employment if discovered.
If you feel this is something you can't fulfill, please call me to discuss other options.
End of email
I didn't think taking a break or taking a break late was Time Card Fraud
1 Answer from Attorneys
Your employer has clearly changed their policy as to what they view as time card fraud. You have been served with notice of the change, and the employer will expect you and all other employees to comply with the new policy. If you can't comply with the policy, call your boss, as s/he suggests, to discuss other options.
