Legal Question in Employment Law in Minnesota

I was just turned down because of a background check that ADP did on me for employment. On the background questionaire I said I did not have a criminal background. I was told by an attorney that my issues were motor vehicle issues. On my background check it states 3 instances of motor vehicle incidents. One is my 3rd dui, another is a hit and run that I paid a fine for and the third is not carrying license on person. What does this have to do with my employment? I am a great employee. I had some personal problems in my life about 8 years ago, hence the drunk driving. I have been to intensive counseling and my life and I have straightened out. I am embarrassed about these issues, but am I going to suffer my entire life because of them. This was for an assistant manager at a Vitamin Shoppe in Minnesota. I am a 58 year old woman. The motor vehicle incidents happened in Wisconsin. Thank you for your time.

The largest problem I see in this situation is that it appeared you were lying on the background questionnaire. While you believed you only had motor vehicle issues, these issues were also criminal in nature.

While I am not a Wisconsin attorney, a 3rd DUI in Minnesota would be a criminal offense (Gross Misdemeanor crime).

A hit and run in Minnesota (according to statute) is at least a Misdemeanor crime.

Depending on the situation with the license, this may also have been a Misdemeanor crime, depending on the results of the case.

The best thing to do in these situations is to realize that the employer will find these offenses, so be open and honest and be prepared to explain the situation.
