61 day notice too late?
I gave notice to my landlord this morning Dec 1st for my lease ending Jan 31st a total of 61 days. However they are saying it is late and we will be require to pay the higher month-to-month rate for Feb.
The lease state ''NOTICE PERIOD (The notice period is two full months on or before the last day of the existing lease in writing unless indicated otherwise herein) sixty (60) days prior to 1/31/07''
That is word for word from the lease.
I just want clarification that I do NOT have to pay for Feb and the court would back me up if they decide to persue it.

Sorry: Notice is effective on the LAST DAY OF THE MONTH in which it is given. Here you gave it on Dec. 1, so effective Dec. 31 and 60 days from THAT is end of Feb.
