Legal Question in Landlord & Tenant Law in Minnesota
I rent someone a room with no lease - tenant didnt pay rent
I rent a room to someone in my house
I never drew a lease up with the person I rent to, she just pays me every month.
People are trying to tell me legally I am still required to give her a 60 day notice, if I want her to move. even though there is no lease
I want to throw her out effective immediately. is that lawful ?

Re: I rent someone a room with no lease - tenant didnt pay rent
This is a tenancy at will, which can be terminated upon written notice. The notice period must be at least as long as the rental payment period. In your case, you must give written notice that you are terminating the tenancy at least 30 days in advance of the end of the calendar month, i.e., give notice prior to the end of May that you are terminating the end of June. If the tenant does not move out after the expiration of the notice period, you must commence an eviction action in the district court of the county where the property is located. You should consult an attorney with assistance with the notice and/or the eviction, if necessary.
