Rental Lease Agreemnet

My daughter signed a rental lease agreement with five other people. A term of agreement was that there would be no subleting allowed unless all 5 agree. In May a person moved into the house without my duaghters permission. No one knew the boy. He had his girlfirend with him and smoked pot. I was concerned with my daughters safety and made her leave the house. I notified the landlord. 16 days later he was still there. I did not pay the May rent and told her I was breaking the lease. Do I have legal right to break the lease due to the fact that she did not make this person leave who had no permission to live there?

As a Landlord of 28 years, I have had similar situations. Of course, the written LEASE controls and I would need to review to advise, but the unauthorized occupant should be evicted under normal circumstances. The other "legal" tenants are normally liable JOINTLY and SEVERALLY, which means if 4 disappear, the last one available to sue will be liable for the ENTIRE balance of rent under the lease.
