Re: Injuries resulting from accident

Same incident/question as the other ''Injuries Resulting from Accident.''

I have gone to the doctor and they did give me a note stating that they felt my injuries were caused by that accident back in June 06'. The insurance company has agreed to pay for my doctors visits, etc. or give me a lump-sum (settlement) of $3500. Should I ask for more or what is my best plan of action? The doctor did state that my pain may never go away, because of the location/possibilities of problem. I can live with it the way it is, but should I ask for more of a settlement then?

Tough to say whether it is a reasonable offer or not. Would need to know your medical history and the extent of the permanency the MD has given you.

Hello, Sam. I seem to recall that I may have posted an answer to your previous question.

It is difficult for me (or anyone, frankly) to reasonably comment on the propriety of their settlement offer without knowing more of the facts. If I recollect correctly, you were injured in a motorcycle accident, and had a previous injury that may or may not be relevant. I seem to recall I cautioned you about foreclosing certain medical claims, which I presume their current offer does not do.

Although motorcycle cases can be difficult (since there is occasionally little sympathy for bikers), it is worth taking a look at the settlement offer, and talking to a lawyer about the facts. What they have offered could be reasonable, if there is a question whether you contributed to the accident, or if a prior injury is possibly responsible for some of your pain. I can't really assess that issue from here.
