Inheritance procedures

My Uncle has expired in Canada, he is Canadian citizen for over 25yrs. In his will he has left everything in my name.I cant afford going to Canada to claim things.

you have to find ways to go to canada because nothing will happen without going there. if he has left big property then u can take loan or help and go there otherwise u have to take decision

you will have to go to cananda to claim teh property you may have to take a loan or arrange for funds for the same

fine. but you have to claim your beaquest.

unlike india in canada beaquest cannot be made excluding any close dependants and spouse and to other without meeting out all dues. such will be held null and void.

so unless we see the document we cannot proceed further.

And a will has to be probated within 6 months!

you will have to visit Canada since he was permanent resident there and i presume all his properties are also situated there. You contact some canadian lawyer. you can find them on "Law Guru" as well.

You have to approach the Bank for loan if you have sufficient funds in Canada to pay the Airfare and other expenses, please take it to your nearby bank or to a friend who will help you out, provided if it is worthwhile if not do not waste your money.

You may request the letter probate and apply to the the clerk of the Probate Court and this may be done in the judicial District where the testator was residing when he died or in the district in which testator owned properties.

You may engage lawyer for submitting and applying the probate.

You may take the help of Public Legal Education Information Centre or Free Legal Centre which are non profit orgnization. The estate will pay lawyer fee.
