Legal Question in Wills and Trusts in Minnesota

Rights of those named in will to know distribution

What are the rights of those named

in a will to know the complete

distribution of funds? My children

were named in an uncle's will

(Minnesota) but we are being told

by the executor that all funds have

already been distributed & there is

no further information to give. Is

it typical practice to give this

documentation to all named heirs

in a will? Do we now have to get a

court order or bring suit to get that

documentation?

Re: Rights of those named in will to know distribution

If you think the executor did not perform his duties correctly you can bring a motion to the Court for an accounting. Then the executor would have to show where the money was spent and why there isn't any left for distributions.

In order to be notified of what's going on during the probate process you have to file a Notice with the Court stating your desire to be notified.
