Re: DUI and Unconscious Defendant
In the event the Arresting Officer has reasonable grounds and probable cause to believe a person to have been driving under the influence of intoxicants the law enforcement officer may elect to obtain a sample of the defendant's blood for testing purposes. If a person is not awake for the process that person can attempt to object to the introduction of the evidence (test results) against himself (or herself) at trial or in pre-trial Motion practice. One who has been tested as such would be well advised to obtain competent legal counsel at once!
