Changing of custody

My Ex is the custodial parent and I have visitation rights. She has had some marital problems and the Department of Humane Services is involved. She has verbally agree to allow me to be the custodial parent and for her to have visitation rights. What actions do I need to take to make it legal binding that I would be the custodial parent? Do I need a lawyer or can I file paperwork on my own?

You will need to file an agreed modification of the prior decree of custody and both of you ned to sign it and present it to the judge for his/her approval.
