I have 3 children 10-14 years of age. Their father left nearly two years ago to return to an old high school girlfriend from 25 years ago. During the year 2002 he had the children to spend only 32 nights with him out of 365. He could have had them whenever he wanted but he could not be bother.

I want to know what is the best way to file for custody.

full custody, or joint legal custody. Do I have to have permission from him on matters with joint legal custody?

Under the circumstance, it seems that you should ask for exclusive custody. If he gets joint custody with you having paramount custody, he will have a right to substantial participation in decisions involving health, education, and training. However, his permission will not be required for you to act in what you reasonably believe to be in the best interest of your children. If he disagrees, he will have the right to request the court review your decision.
