Rights on Accident
Yes on March 22, 2002 a man ran a redlight a hit my daughter he was going 45 miles an hour and she was estimated going 4 mile. he was in his brother in laws truck, had suspenden license. My daughter was taken to hospital by ambulance was releaesed same day was ahd problem for about two weeks. We have tried talking with them and the owner of the truck they are all self employed, no insurance. The guys wife wo hit us says they wwill pay not to call brother in law anymore who owns the truck. the car value was about 4500.00 and to fix estimate was 5200.00 so car was toatlled. we were trying to just be nice and get them to work with us an dpay for the towing, price of car and unaid medical bills. after we finally got the estimate which we thought we needed before futher converations they want call us back. what I need to know is do i need a lawyer will ir help. There was a witness that said on the acccident report that the light was yellow he had to back up caus ethe light turned red he was unable to turn but thr other driver one that hit my daughter came through thr light on red and hit my daughter.....

You need to get a lawyer to sue the driver and any other entity that may be vicariously reponsible for his driving. Also, the attorney will probably ensure the defendant's driver's license is suspended. Also, your daughter's uninsured motorist insurance will be liable.

If they are self employed, they should have some business insurance, and if that was a company truck with the driver being permitted to use the truck, the the insurance should cover it.
I think they may be trying to "bulldog" you. A lawyer could atleast get involved to the point to determine if they have insurance.
