The law requires you to wait a reasonable amount if time before using another service, and not still owe the first guy the rest of his fee. I can't tell you an exact time that is reasonable, it is determined based upon the particular facts of each situation. But, if you have made repeated calls or letters to the first guy, without an explanation as to why he hasn't finished, you're probably of the hook from having to pay him anymore. Hopefully you didn't give him all his f fee before he finished the job. If you did, or the second guy cost more, you can sure the first guy (probably in small claims Court) for the extra money you had to pay to get the work completed.
