Legal Question in Construction Law in Missouri
If I signed a contract which stated id pay so much money up front & give the company my 1996 Lincoln town car when the job was completed & had 2 breach the contract as 1 of the workers was harassing me... lying about who he was legally...lying 2 an officer via cellphone as 2 who he was etc as he had warrants.. by not allowing him back on my property until he could do so...co stated id breached my contract. No permit which is required in my town was obtained..even tho I asked & asked...he was in a hurry 2 get the job done b4 city hall opened...he is suing me 4 my car in small claims court...can he take it - does specific performance apply in Missouri..basically can he take my car? He's already stated he's put a lien on my house & car...

If he is not licensed as a contractor and failed to obtain a permit, and put unhealthy persons on your property, you should prevail. As part of your defense, tell the judge that the plaintiff can complete the job, if he obtains the permit, and doesn't bring dangerous people on your property. You might want to consult directly with a civil practice attorney, in your area to prepare your side of the case.
