Legal Question in Criminal Law in Missouri
Needing Information!
I was visiting family, and out with my ex sister in law and one of her friends. We were stopped, and the car and our personal belongings searched. I had a very small amount of Meth on me, and when the car was searched, 2 8 balls were found. This did not belong to me!!!!! Since neither of the other people in the car acknowledged that it was their dope, Missouri police are trying to stick me with the blame for the 8-balls. I am disabled, have cancer, and only tried it once. I have to go to court there in May and need to know what to expect. I am NOT a drug dealer, nor do I use this stuff, but have tried it one time! With my health issues, I need to know what I can expect, especially living in another state! ANy information a Missouri attorny can give me, would be greatly appreciated! Thank you, B. Ingram

I need more information to process this fact pattern. Who owned the car? Were you driving? Where was the meth found? Where was the coke found? What was the initial traffic stop for? A serious crime or a minor traffic violation?

As the attorney who responded previously said, and as I'm sure you already know, you are facing serious charges. Possession of even a small amount of meth is a felony here in Missouri, and the amounts that you state were found in the car make everything exceptionally serious for you. You definitely need to hire a criminal defense attorney in the geopgraphical area of the arrest. So, if you are charged in the St. Louis area you need to hire an attorney from around here. Or, if this happened closer to Kansas City, you will need an attorney from that area. There really is a tremendous difference in the process and the individual judges depending upon exactly where the charges are pending. Your attorney will need to interview you in detail, and also the other passengers in the car if possible. Your attorney will also be obtaining copies of the police report, lab report, any statements you made, and so forth. Armed with as much information as possible your attorney should be able to give you a professional opinion as to the range of punishment you are facing, the chances of success at trial or on pre-trial motions, and also possible plea bargain and sentencing options. Do not be surprised to see quotes for attorney's fees beginning at the $5000.00 level and going up from there. Of couse, if you are not able to hire a private attorney you should request the Court to appoint the public defender to represent you.
