Legal Question in Criminal Law in Missouri

if I have been told that I am on a stores servalence video stealing. Do I have the right to see the video, if I am sure I wasn't in the store at the time of the incident.

If you are charged with the offense, your lawyer can obtain a copy of the video through discovery in Missouri. The State will not be able to use any such tape against you at trial without providing it to you. That does not mean they would necessarily need the tape in evidence to convict you. If you are charged, hire a lawyer.

Have you been charged with a crime? If so, then you need to hire the very best criminal defense attorney you can afford. Either your attorney can defend the charge against you, or your attorney can negotiate a plea bargain that should avoid most of the worst negative consequences. If the tape does not show you, and the store does not have any other evidence against you, then the charge may not be brought in the first place,or may be dismissed. In any event your attorney will definitely get to see the tape if it exists. Good luck.
