I Need Help
Back in 1998 I was arrested and charged with Driving While Revoked,DWI,and Impeding the flow of traffic.Isn't there a statue of limitations on theses cases?There was no accident.I took it to trial in 2001 and the officer didn't show so the court reset it.I have finally gotten my driving record fairly stable and was legal again until now.I do have SR22 insurance but I have to drive 38 miles one way to work every day.So I need to find out how I should proceed.The court told me that the warrants have been out since 2001 and yet I got have never heard anything until today.Thank You for your time.

One thing that you might have left out of your post is the fact that you must have failed to appear in court when the case was rescheduled for trial, and that is why there were warrants issued. That would also be the reason why no statute of limitations will prevent you from being prosecuted. Were you represented by an attorney? If so, you should contact that attorney now. If not, you should hire an attorney as soon as possible. If you have not already been picked up on the warrants and made to post bail, there is a chance that an attorney can save you from going through this process, or at least make it as easy for you as possible. Also, there is a good chance that the attorney can either sucessfully defend the charges against you or negotiate a favorable plea bargain on your behalf.

There is no statute of limitations where there is a warrant outstanding. A warrant being there indicates that there was never final disposition on your case. The case was filed, and then a warrant was issued when you were not present for the hearings. Statute of limitations applies to how long a party has to decide whether or not to file against you-- inapplicable here.
