Legal Question in Family Law in Missouri

If you have received state aid for a child are you required to tell the state who you think the father is? If you are required to do so and did not and 5 years later you want to take the alleged father to court can you be in trouble for not telling the truth to the state? This person has been telling people for 5 years that he is the father not telling him this just everyone else. If he is the father is he going to be legally responsible to pay back child support?

You have asked many more questions than you may realize. I can answer some of them this way. If you give false paternity information when applying for state or federal aid, you can be prosecuted for fraud. This does not mean you are guilty, but you can be sued.

If a woman is getting aid for a child born out of wedlock, and later gets an order of support from a court, as to the father of that child, it may be viewed as improper to continue getting state or federal aid, if the amount the father is paying puts the mother out of eligibility for the aid. In that case, she may have to pay back improperly obtained or retained aid payments.

If the State of Missouri or the federal government is providing aid for a child, it may, and often does go after the noncustodial parent for reimbursement of aid provided.
