Legal Question in Civil Litigation in Missouri

Cell Phone blunder

Can I sue a person for running a phone bill up and not paying for it? I got the phone for her in my name. She paid the bills for several months (even sent to her address) We were never a couple, just coworkers. She was going through a divorce and I just wanted to help. I moved away and about 3 months ago got a notification that my credit score had dropped over 100 points. I found out that her bill was the reason why. I never made a call on the phone, never paid a single bill, or know anybody that she would've ever called. I recently settled with a collection agency (never receiving any notification at all, probably because of the move). The total charges were $1661, I paid them over $750 this month and must pay them $700 next month. Do I have a case or is this just a tough lesson learned?

Sincerely,

Tom

Re: Cell Phone blunder

Based upon the facts you described, it appears that you have grounds for a law suit. The success of the suit will be based upon the facts of your relationship with her, and how you can prove the agreement. I cannot tell you whether you will win. But, the facts you describe do seem compelling enough to make a suit possible. You also did nto induicate whether this gal has any income or other assets from which to collect.

There are reasons to file an action in small claims court versus an associate court action. You should discuss these with the attorney you select to represent you.

Good Luck
