Child Support-Cut off Date.

I have a son that is a senior in high school. He lives with his father. I pay the father child support. This is his last year in high school. During this year he was to go to school 2 1/2 hrs then work a job for remainder of credits. He did go to school 2 1/2 hrs per day but never worked his appointed hours of 20 per wk. He flunked this work study program all year. So technically he schooled less than part-time. Do I have to pay child support for this year while he did virtually nothing? He didn't do anything full time (12) hrs. He just slept and hung out with friends.

The child support statute says that the child support obligation terminates when the child reaches the age of 18 years unless the child proceeds with his or her education after high school and follows several very specific requirements in so doing. One of these requirements is for the child to be enrolled in college by October 1, following graduation from high school. If you child has turned 18 you may want to file a Motion to Terminate Child Support.
