Legal Question in Immigration Law in Missouri
My granddaughters father is not a legal citizen of the US - but he is providing support for her - is there a way she can file any papers to help him stay here.
1 Answer from Attorneys
If his US citizen daughter is over 21 years of age, she can petition for her foreign father. If he came to USA illegally (without a visa), he will still have to go back to his country to apply for a visa and a required hardship waiver.
Having a minor US citizen child and paying child support for her, unfortunately, doesn't enable him to apply for any sort of status or visa by itself.
If he is married to a US citizen, she might be able to petition for him too (and he'll have to go to his home country to apply for a visa, as well, if he came to USA illegally).
