Legal Question in Immigration Law in Missouri

Proof of citizenship

My daughter who hasn't lived with me for 5 years was born in Canada and mother is Canadian. She turned 18 in 2/09. She is wanting to get proof of citizenship and her attorney has threatened to supeona me to force me to provide information to help her get citizenship or send me to jail. Not that I wouldn't have provided if simply asked, but can they force you to provide information for citizenship or is her attorney bluffing. My daughter and I are estranged and she probably assumed I wouldn't help. I don't like the strong arm tactics and wanted to know if they truly could force me to help her.

Re: Proof of citizenship

No, they cannot force you. Why would they send you to jail? You can either provide information about YOUR citizenship voluntarily or the court can subpoena you. However, as she is an adult, I don't see what they can actually do.

Re: Proof of citizenship

Dear Inquirer:

It is not clear what proof of citizenship your daughter is requesting from your question--proof of YOUR US Citizenship, I suppose? If that is the case, you do not have to voluntarily relinquish any documentation. If you are subpoenaed, however, you must comply or risk being found in contempt of court, for which you could be jailed.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule a confidential consultation to discuss this matter further.
