Legal Question in Employment Law in Missouri

I am filling out an HR packet to work in a school, and want to make sure that I am filling it out correctly. I was arrested for a DWI in July 2009, but received a SIS. So no conviction. The question asks if I have plead guilty or no contest to anything. What should I put?

It depends on how the DWI SIS was arranged. If you plead guilty to the DWI in order for to receive the SIS, then stating that you did not plead guilty would be falsifying your application. If you did not plead guilty but received the SIS as part of the trial process, then you can accurately state you did not plead guilty.

If you plead no contest and received SIS without a conviction then stating otherwise would be falsification. If you think that you need to state that you plead either way, I would recommend doing so with an explanation of the SIS and highlight that you were not convicted.

You should also look into getting that no-conviction DWI expunged from your record. Almost all criminal defense attorneys should be able to do that for you.
