renting duplex, tree feel on my car, whos responsible?

I am renting a duplex and a week ago it was very windy in my area. I normally park my car on the side of the street right by my mailbox and a large tree on the same property fell on my car, totalling my car. I informed the landlord about the situation. At first, he seemed worried b/c he said he has a $1000 deductible for his homeowners insurance. Now, he stats that he is not liable and will not pay at all. I tried to negotiate with him by having my rent reduced ($200/mo) for the last 3 months of my lease, but he insist that he is not liable. My question is, who is liable? Is there any documents i can show him that he is liable? any help would be great.

Your landlord or your landlord's insurance carrier may very well be responsible. I would highly recommend that you contact an attorney to help you with this. The attorney will find out what insurance policy or policies are in effect, whether they provide coverage for your loss and to what extent.
