Legal Question in Landlord & Tenant Law in Missouri
unlawful entry form accepted by barry county courthouse
I am trying to find an unlawful entry form to evict tennants. I do not have a written lease with the tennants and they did not pay rent for March or April. I listed the property with a realtor who gave them a 30 day written notice for nonpayment on April 1st, rent is now owed for March, April, May, June and going on July. I have talked to the clerk at Barry county courthouse, I was told that the papers to be filed to evict had to be very specific in order for the judge to sign, then send to the sherrif and that an attorney usually files the legal documents. I was hoping to avoid paying 400.00 to an attorney to get the renters out. I can not find the forms on any sites for this county, can you advise the easiest and cheapest way to get the renters out?

Re: unlawful entry form accepted by barry county courthouse
I would advise you to hire an attorney. It sounds like you may have an unlawful detainer or a rent and possession situation, or both. I would need to discuss the facts with you more. There is no easy form for unlawful detainer; these suits are more complicated than the garden variety eviction.
Rent and possession forms exist, but I would not proceed with that action either without an attorney. If you are incorporated, the entity has to have an attorney, as you cannot represent the company in a legal capacity. If you would like to discuss the matter further, I may be reached at (816) 842-3717. [email protected]. Good luck. Matthew Guilfoil
