Legal Question in Medical Malpractice in Missouri
Prenatal Care and Delivery
When my 7 year old son was born, my doctor left me in labor to long. He did not induce my labor until the second day I was at the hospital, even though my contractions were 1 minute apart. When they induced me, they found out that his umbilical cord was wrapped around his neck and he had bowel movements inside me because he was so stressed out. I had to have an emergency C-Section. He was so sick that he had to go to Cardinal Glennon for over a month and he had to have surgery. Now he has learning problems and bad asthma from the complications. I was going to try to sue the doctor when my son was younger but the doctor, Dr. Covarrubias, left the country to go to Mexico. I was just wondering what I could do now because he is having a lot of problems due to the complications at birth? I don't think it was fair for him or I. If you could just let me know if there is anything I can do I would really appreciate it.

You need to immediately investigate the birth trauma and possibly move very quickly to protect the statute of limitations. It is impossible to say if there is a claim, but it sounds like there may well be. In Missouri and Illinois there are possible claims by both the parents and the child, but the time for the child to bring his claim is longer. In your case, the parents' claims have probably already expired. You should contact experienced counsel immediately. First, I am very sorry to hear of your son's problems; second, this is almost exactly the same case I took to trial and won for my clients in July of last year, and several other cases I've settled.
Of course, more information is needed; all such claims are goverened by a statute of limitations which is an 'expiration date' on your claim; there are exceptions which may/may not apply to lengthen the time; in MO the limit is only 2 years for your claim, but 2 years after your son's 18th birthday on his claim; did the birth and treatment happen in MO or IL ? That will also be very important to determine which state's law will apply.
