Legal Question in Personal Injury in Missouri
If the car you are driving hits another car but the car you are driving is not insure. but you have car insurance on your own vehical. are you liable for the damages of the reck car. or is the owner of the car that is not insure liable for the damages.. this happen in the state of Missouri. Will my insurance pay for the accident? Who should be responsble for the accident.

Under teh Lamento doctrine, th eone with insurance will be teh oen found most liable, if there is equal liability among two persons. But, the driver is the first liable person, if there is liability. Under this case, you were driving, if you were negligent, you may be liable. If you have automobile liability insurance, then your insurer should provide an attorney to defend you. The plaintiff ( the injured party) might try to go after the owner of the vehicle too. The attorney that defends you may help determine the relative liability of the vehciel owner (if ther is any liability)
