Legal Question in Real Estate Law in Missouri

My boyfriend is on the lease, but his deadbeat 21 yo son is not. I agreed to let him stay while his grandparents were out of town. Then they came back and said he could not live with them anymore. He told me he was getting an apartment on October 18. It's December 1, and not only is he not gone, but he treats my kids like crap, walks all over me, doesn't do anything around the house even when asked nicely, and doesn't pick up after himself. I've missed a ton of work from illness and I'm borrowing money just to keep a roof over my kids head and food in thier stomachs, and this perfectly capable man is mooching off of me! Can I just kick him out since he doesn't pay anything and doesn't have a lease or do I have to legally evict him? To my knowledge he has only recieved one piece of mail at our house, and is still using his grandparent's adress as his mailing address.

It appears, uner the facts you described (if your boyfriend agrees) you can give the 21 year old notice to vacate, and then file an unlawful detainer action against him. It will take at least afew weeks to finish, but it shoudl suffice in geting him out. If your boyfriend does not agree with the eviction, then you might have some problems. You could file an unlawful detainer action, or alleget a partial sublease and sue the son for rent and possession. You may have to get the landlord to release you from teh lease, so that you can find a different place for you and your kids, and let the 21 year old's father support him.
