Legal Question in Real Estate Law in Missouri

so my boyfriend i started dating at the beginning of the school year told me he would get me an iPod touch for Christmas. He then started treating me like shit November and December. After those two months i told him we were through and he begged me to stay and i told him that iPod would make up all the bullshit and we could start over because id give him one more chance. So he gets me a 64g iPod touch the 11th of Jan with his student charge at school. to make up for all the wrongs he did and then we start dating again. Then we have a big fight the 23 of Jan and he tells me that if i don't get physical with him within a week that he is going to take the iPod back and if i wont give it to him he will report it stolen to the school and the police, and that he will get the money back in his account because of the 30 day return policy on his student charge. Am i obligated to give back a gift because its still within the 30 day policy? Does he really have a legal case. How can i prove he gave it as a gift. I have the receate but he can also print of the reciete. PLZ help. Thanks

It sounds like you are heading toward a path of no good. This could end in tragis abuse. Give him the Ipod and break things off between you two. iAccording to yrou story, you only got back together with him because you got the ipod. That appears very crass and not what one would expect from a lady. You might win in alaw suit for falsely reproting the ipod as stolen when he gavive it to you in exchange for you devotion to him. But, you might pay much higher price to win that suit. First you will be accused of theft and possibly expelled. You might spend a day or night in jail. You will incur legal fees to try and stay in school and to defend the criminal complaint. Your reputation might be damaged.

You need to ask yourslef itf an ipod touch is worth all the expense and hassle. You said you would stay with him if he bought it for you. He says he will go away if you give it back, Is it really worht that much to you? now that the Ipad is coming out, Ipod touc will cost a lot less.
