Legal Question in Real Estate Law in Missouri

Which state lawyer to use?

I live in Pennsylvania an am interested in buying a property in Missouri-no realtor involved. Should I have my local PA lawyer handle the transaction or contact a lawyer in Missouri?

Land is controlled by the law of the state wherein it is located. Each state's laws vary a bit on issues concerning the titling and financing of real estate. For example, in Missouri th elaw provides a relatively unique method of securing real estate which is pledged as collateral for a loan. instead of a mortgage, Missouri uses a Deed of Trust, the only other state with a similar procedure is Florida.

Accordingly, I strongly recommend retaining counsel in the state wherein the realty is located.

I believe that it is wise for you to hire an attorney to represent you in this transaction, and that attorney would have to be licensed in Missouri.

I would also warn you to avoid attorneys who use this list only to solicit new business. Good luck.
