How late is late? Within 1 year of employment, some men assumed and labeled me the type of person who would sleep around to get pay raises. I was devastated. Company meetings followed, the guys got off the hook with a slap because I was too embarrassed to file any charges. Approximately 8 years later I discovered these men had spread rumors and all the following years I had a reputation but was unaware. A year later I left work on disability after a sudden death in the family. I am still unable to return. I have a great fear of returning to the place. I am extremely depressed. Is it too late to file charges of any kind? It has been approximately 12 years since the initial incident. I have been on disability for 3 years and am receiving half of what I use to make.

In order for a claim of sexual harassment to be viable,the last incident of harassment has to occur within 300 days if the administrative claim is filed with the federal Equal Employment Opportunity Commission, or 180 days if the claim is to be filed with the Illinois Department of Human Rights. The Statute of Limitations does not depend on the date of the first incident of harassment, but the date of the last incident.If the behavior is ongoing, a claimant may relate back to earlier incidents, and include them in the claim, but this depends on the length of time gaps beteween incidents. For instance, if one alleges to have been harassed over the last six months, and before that 3 years ago, the earlier occurrences would not be considered part of the claim.
