Legal Question in Wills and Trusts in Missouri

12 Years After Death Estate Question

My father last saurving parent died 12 years ago. The estate was not filed probate since it was disbursed entirely prior to death except for life insurance policies. This was done shortly after receiving the monies. The estate was under $50,000. Recently it has come to light, there is some stock still in his name. It is believed this is under $200 value. They need papers of certified Executrix and I think estate papers. I am having trouble knowing who to ask and how to get this finished without spending more than the return is to satisfy siblings request. There is also unclaimed monies listed with the state, althought again small amounts, but cannot be claim without proper paper work. What is the paper work needed, where and how do I obtain it, and what is the least costly way to accomplish closing this estate finally. I checked with the county clerk and she suggested getting a lawyer cause they could tell me which papers I need to fill out. Thank you for your help. Sincerely, Debbie

Re: 12 Years After Death Estate Question

In Missouri after the elapse of one year from death there are only two procedures available; A detefrmination of heirship or, if the total asset value is less than 40,000, a small estate proceeding.

Please contact me if you would like help in either proceeding.
