Legal Question in Workers Comp in Missouri
Workers Compensation rights
I was injured on the job. An 18 wheeler hit the John Deere tractor I was driving. His fault. My company's work. comp. sent me for x- rays only, then put me off for 3 months (no medical care). My tractor was cut in half, meaning I was out of a job, also Greene Co. Hwy. Dept. claimed no such thing as light duty. I was not fired, however I can not go without a paycheck. Accident happened Oct. 22, '08. Nov 3, I started a new job, Last Tues., Dr. orders stated no work for 1 month, wear a neck collar for 1 mo, go back in 1 mo. to see if I will be taken off work longer. I do have an Attorney, no help whatsoever. I can not go 1-2 months with no income. If I do not follow Dr's orders, my condition is so severe, I couldl be paralized. I have to have money coming in every week. No longer working for the comany in which I was injured, Is there any hope for me, or am I going to end up in a wheelchair the rest of my life? Had the company taken care of me like they should have, I would have had an MRI that day, not 3 months later, I would have immediately recieved medical attention, and they would have had to pay me some sort of compensation for time missed from work. Please help me. I have 3 kids to feed. I know I've been done wrong.

Re: Workers Compensation rights
If you have an attorney, you should be asking him for help- no lawyer here or anywhere else can help you if you already have counsel.
Have you contacted him/her? More importantly, is your lawyer's practice focused on representing injury victims?
Re: Workers Compensation rights
Does your lawyer represent you for just a workers compensation claim, just a claim against the driver who hit you, or both? I agree with Spencers answer, that if you already have a lawyer who currently represents you, you should asking him/her, not us. If you dont like the answer or think theyre not adequately answering or helping you, you maybe you should conside terminating the lawyers services, getting your file, and then getting another lawyer, in that order.
