Legal Question in Credit and Debt Law in Montana

served by a veterinarian we have been paying along

We were served by a veterinarian in Feb. 2008 that we have an oustanding bill with. We are NOT in default as we have been making our monthly payments. We feel as if this is personal against us.

We have continued to make our monthly payments even after being served and they have accepted those payments. Is that legal for them to continue accepting our money after being served?

DO you have a written settlement/payment agreement?

That would normally be a defense to the lawsuit.

Montana Statutes

28-1-1401. Accord -- definition and effect. An accord is an agreement to accept in extinction of an obligation something different from or less than that to which the person agreeing to accept is entitled. Though the parties to an accord are bound to execute it, yet it does not extinguish the obligation until it is fully executed.
