Legal Question in Consumer Law in Nebraska
EBAY liability
I sold a 1964 Fender bass on Ebay. I stated that it hadn't been played in years, and I had no return policy. The buyer emailed me that the pickup needed rewound, and that would make it much less valuable. Am I liable for anything?

Re: EBAY liability
Maybe. Even though you attempted to cut off any liability by asserting a "no return" policy that you made to protect yourself, there may be an implied warranty under the law that you were selling a functional guitar and not pieces of wood and metal. Further, you may have a contractual obligation to certain remedies available to the buyer under Ebay's terms of service that you accepted when you used their service to market your guitar. It would probably be in your best interest to attempt to make a fair adjustment in price if that will satisfy the buyer.
