Legal Question in Business Law in Nevada

Effects of Breach

I sold my business some months ago and carried back a large note. In the agreement, I included a non compete agreement barring me from engaging in any like business, etc. The buyer has now breached his agreement and note with me and I have initiated collection proceedings to get my money. In as much as he has breached his agreement with me, does that now releive me of the non compete clause in the agreement?

Can I now engage in a like business.

Thank You.

Re: Effects of Breach

the clauses in a contract are usually independant, so a breach of one does not invalidate the contract unless you bring a lawsuit for that.
