Legal Question in Criminal Law in Nevada

gamma-butyrolactone

Gamma-Butyrolactone, a substance

known as GBL, is currently a list

one, but not a scheduled,

substance for the DEA. I live in California, but wish to ship the drug

to a mailbox company in Nevada.

A company selling a schedule one

substance must register the sale to

the DEA. Assuming that occurs,

what other rights does the

government have?

Can customs impound indefinitely,

or at all, GBL bought from another

country?

Must I demonstrate a legitimate use

for the substance if I were

confronted by the DEA?

You might want to take a look at these code sections:

Health & Safety Code 11054(e)(3) - GBL is listed in California as a Schedule I controlled substance.

H&S 11350 - possession of a substance listed in H&S 11054(e) - up to 3 years in state prison

H&S 11351 - possession with intent to sell (which includes transfer a Schedule I substance - up to 4 years state prison

and finally H&S 11352 - sale, transport or transfer of a Schedule I controlled substance - up to 5 years in state prison.
