Name change of minor

I have been married to my current wife for 10 years now and been with her for 12. When we met she had a 2 year old son who is now 13 will be 14 in July. Whom which I have raised as my own son. His biological father has NEVER been in the picture and has never made any attempt to contact him, my wife assured me he knows about his son. Just never made an effort, and lives in a totally different state. My question is how can we change our son's last name to the family name? Will the biological father still need to be petitioned? The Biological father is not even on the birth certificate. Just would like to know what steps we could take to make this go as smooth as possible.

You would need to Petition the court for a name change. It would be simpler if you got the natural father's consent. If not, then you would have to notice a hearing before the Judge who would probably grant your request.

You would need to do a step parent adoption which is a two step process. One we would need to terminate the biological father's parental rights. Then we can proceeds with the step parent adoption.
