Legal Question in Family Law in Nevada

The Fathers Rights

My roomate is going to be having a baby in June, he is not with the mother currently. Since they have split up she has made threats to him about never seeing the child and to claim the father as unkowen on the birth certificate. She has also said that if he does try to fight for his child she will make his life miserable and take him for all his money and he still will never see the child. What are his rights in this type of situation? What can he start to do now to ensure some custody rights? He is willing to pay child support, but he just wants to see his baby. And also can she just take all visitation from him, or will she have to prove he is an unfit parent? Thank you for all your help I'm just trying to find some info for him because he dosen't feel he has any options.

Re: The Fathers Rights

I assume they are not married. He should keep a log of all of her various threats. (He'll need it for his afffadavit) Then he should file a Petition to Establish paternity and a Motion for DNA testing to establish paternity, specifed visitation and child support. Child support is 18% of his gross income up to an inflation adjusted cap. Absent some serious drug, alcohol, criminal or mental problem, your friend should have no problems. Depending on the circumstance he may get more time depending on work schedules, the Girl friends problems etc. On a scale of 1 to 10 this is a 2- he just needs to get the paperwork straight
