Where to File Divorce -- Nevada or Virginia?

My husband and I are Nevada Residents, but we live overseas because of his job. We are preparing separatoin and I will return to Virginia to live during separation. Our property is in VA. Both of us are U.S. Citizens. Where do I file divorce?

Nevada has a 6 week residency requirement. If you are not returning to Nevada to live then you cannot file in Nevada unless you live in Nevada for at least 6 weeks. If you plan to live in Virginia and that is where your property is, you should consult Virginia counsel and see what that state's residency requirements are. If you meet Virginia's residency requirements that is where you would want to file.
